Can safety directory write up driver for preventable if DOT didn't issue a ticket?

If a driver is involved in a accident and the responding DOT officer doesn't issue him a ticket nor does he file a police report can the company safety director charge you with a preventable accident when he has no police report or a drivers citation to back him up.

He had nothing to physically look at to make his decision.
