I work for a trucking company that has a small fleet of trucks. These trucks are leased and not owned by the company.
They in turn make all drivers sign an independent contractor lease agreement. Drivers have no control or say in any decisions pertaining to the work we do.
We are told how many loads to do and how to do them. The trucking company takes 60% of the gross pay and considers this payment for all expenses pertaining to the truck including lease. I realize that this is a misclassification issue.
The question I have, is it legal for a trucking company to lease you a truck that they are leasing themselves.
